1. Acceptance of Terms
By accessing or using the PharmEtrade platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use our Service. These terms apply to all users, including buyers, sellers, and visitors.
2. Account Registration
To use certain features, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Keeping your business license and verification documents up to date
3. Buyer Terms
As a buyer on PharmEtrade, you agree to:
- Purchase products only for lawful purposes and in compliance with applicable regulations
- Provide accurate shipping and billing information
- Pay for all orders placed, including applicable taxes and shipping fees
- Comply with all applicable pharmaceutical purchasing laws and regulations
- Maintain valid licenses required for purchasing pharmaceutical products
4. Seller Terms
As a seller on PharmEtrade, you agree to:
- List only products you are legally authorized to sell
- Provide accurate product information, including NDC codes, expiration dates, and pricing
- Fulfill orders promptly and in accordance with the listed terms
- Maintain proper storage conditions for all pharmaceutical products
- Comply with all applicable laws regarding pharmaceutical distribution
- Accept returns in accordance with your stated return policy
5. Transactions
PharmEtrade acts as a marketplace platform facilitating transactions between buyers and sellers. We are not a party to the actual sale transaction. Buyers and sellers are responsible for the terms of their transactions, including pricing, shipping, and returns.
6. Payments
All payments are processed through our secure payment providers. We accept credit/debit cards and ACH bank transfers. Sellers receive payouts according to the payout schedule outlined in their seller agreement, less applicable platform fees.
7. Shipping & Delivery
Sellers are responsible for shipping orders within the handling time specified in their listings. Shipping costs and delivery times vary by seller and shipping method selected. PharmEtrade is not responsible for shipping delays caused by carriers.
8. Returns & Refunds
Return policies are set by individual sellers and must be clearly stated on their product listings. Buyers should review the seller's return policy before purchasing. PharmEtrade may mediate disputes between buyers and sellers.
9. Prohibited Activities
Users may not:
- Sell counterfeit, adulterated, or misbranded products
- Circumvent the platform to complete transactions outside of PharmEtrade
- Manipulate pricing, reviews, or search results
- Use the platform for any illegal activity
- Interfere with the platform's operation or other users' access
- Create multiple accounts to evade restrictions
10. Intellectual Property
The PharmEtrade platform, including its design, logos, content, and software, is protected by intellectual property laws. You may not copy, modify, or distribute our materials without written permission.
11. Limitation of Liability
PharmEtrade is provided "as is" without warranties of any kind. To the maximum extent permitted by law, PharmEtrade shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.
12. Termination
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a risk to the platform or other users. You may close your account at any time by contacting support.
13. Changes to Terms
We may update these Terms and Conditions at any time. Continued use of the platform after changes constitutes acceptance of the updated terms.
